What Is the Fraud and Abuse Regulation?

With increasing risks associated with fraud and abuse caused by the corrupting influence on money on some health care decisions, the federal government enacted an anti-kickback law to curtail this influence. This law makes it illegal for a person to knowingly and willfully receive or pay anything of value to influence referrals of federal health care program business. Violations of this law can lead to both criminal and civil penalties.

At Kerr & Hendershot, we assist health care providers and professionals in setting up procedures and transactions that comply with fraud and abuse regulations. We help identify and define remunerations and referrals, so to help you understand your responsibilities under the law.

What Are the Safe Harbors?

The act lists numerous safe harbors that exempt certain transactions from criminal and civil prosecution. It is important to note that these safe harbors are not exhaustive, but should be used as guidance when establishing transactions that comply with fraud and abuse regulations.
