Under Texas property code section 27.001(4), a construction defect refers to any matter concerning design, construction or repair of a new residence; or repair or addition to an existing residence. Texas Residential Construction Liability Act (RCLA)
Construction defect disputes between commercial property owners and designers, general contractors or builders are typically regulated under the Texas Deceptive Trade Practices Act (TDTPA). Parts of code section 27.001 restrict the amount of damages a property owner can reclaim for a construction defect, or force the owner into arbitration and mediation. For residential property defect disputes, the Residential Construction Liability Act (RCLA) is often a more appropriate body of laws under which a homeowner can file a claim against an architect, designer or general contractor.
