Enforcement of Support and Custody Orders

Enforcement of Support and Custody Orders

Houston Child Support Enforcement Lawyer

It is against the law to break a court order to pay child support or to break visitation rights granted in the standard possession order, where child custody arrangements are determined. Preferably, child support is collected by the state through payroll deduction and sent directly to the custodial parent. This program protects both sides and eliminates potential child support disputes.

If a non-custodial parent falls behind on child support, the custodial parent has the option of scheduling a hearing to enforce the court order. Kerr & Hendershot attorneys have extensive experience representing parents on both sides of the enforcement issue.

Are You Trying to Collect Child Support Payments?

Fighting the state system to collect the money your child is entitled to for support is complex and often frustrating. The state is backed up with enforcement complaints. Family law attorneys at Kerr & Hendershot will work diligently with the custodial parent to do everything possible to recover the money owed. If we cannot work out an acceptable plan, we will file on your behalf with the court and represent you at the enforcement hearing.

Have You Been Called For a Child Support or Custody Hearing?

Contact our offices in Houston to arrange a consultation with a member of our Texas family law team to discuss your circumstances. We will begin working immediately to collect supporting evidence to work out a plan that the state will find acceptable for a modification.

Paternity Rights

If you are the non-custodial parent, you have a right to parenting time or possession, unless your parental rights have been terminated. Under Texas law, your visitation rights cannot be tied to your child support payments. Even if you are behind in payments, the custodial parent has a legal responsibility to allow you the parenting time set forth by your court order. If you are being denied your legal rights, talk to us right away.

Contact us to discuss your child support enforcement issue with a lawyer on our family law team. Our offices are located in Houston and Corpus Christi, Texas. We are able to meet with you at our Corpus Christi office by appointment only.
