Child Custody and Child Support

What Will Be In Your Child's Best Interest After the Divorce?

When it comes to child custody issues, count on one thing: Texas judges expect parents to consider the best interest of their children. Too often, divorcing couples are caught up in the emotions and egos of who wants the children more. That's not the question, so we'll repeat it: What is in the best interest of the child?

At Kerr & Hendershot, we have been representing families through the divorce process for more than 20 years. We know what questions the judges will ask and what the social services departments in various counties will expect to see. In most cases, looking at the best interests of the child comes down to a simple question: who has served as the primary caretaker for the kids? That means looking at getting the children up for school, cleaning up after them and taking care of their health care needs. Emotional stability is critical and looking at the big picture, three, five and even ten years into the future is key.

If child custody and parenting time issues will be an important part of your pending divorce, make sure you have the right attorney protecting you and your children's interests. Contact a member of our family law team to discuss your concerns and needs. An experienced Texas family law attorney will sit down with you and explain the process. You will find us accessible, responsive and available when you need to come to us with your concerns and questions.

You have some tough decisions ahead of you. Start with the easy one. Hire an experience lawyer at Kerr & Hendershot for all of your family law needs, including:

Child Support Issues

Under Texas law, child support is administered through the courts and arranged according to specific guidelines based on net disposable income. In some cases, additional child support can be arranged to meet special health care, educational or lifestyle needs of the children. We work with the opposing attorney to determine a fair and proper level of child support that will protect the lifestyle and interests of the children.

Modifications and Attorney General Child Support Hearing

The courts recognize that employment conditions change and people are not always able to keep up with their child support payments. If you have lost your job, or have been unable to maintain your monthly payments, you may be scheduled for an Attorney General hearing to Child custody and child support enforcement. During the hearing, you may have legal representation to present your case for a modification that the court will find acceptable. The custodial parent may also hire us to show evidence that the monthly award should not be reduced and all money owed should be paid.

Contact a child support and custody attorney to arrange an opportunity to meet with one of our lawyers at our Houston or Corpus Christi offices. We represent clients throughout Texas. We are available at our Corpus Christi office by appointment only.
