Bankruptcy Objections Are Your Right as a Creditor
Creditors have the right to protect themselves from financial loss when one of their clients files for bankruptcy. Not all debts will be automatically discharged by the bankruptcy courts. By filing a proof of claim, a creditor can prove that the money is owed based on a legitimate contract. If the debt is included in the debtor's bankruptcy filing, a creditor has legal options to file a complaint under 11 United States Code (USC) Section 523, that a specific debt should not be dischargeable.
The creditor may object to the entire discharge of a debtor under certain circumstances, covered by 11 USC Section 727. Specific debt, or an exception to discharge, requires a different strategy than filing a legal petition to determine dischargeability of a debt.
Altogether, there are 18 types of debt that are non-dischargeable under the USC. Knowing case law and understanding how specific judges will rule on a dischargeable debt requires in-depth knowledge of the bankruptcy code.
