What Constitutes Infringement?

Infringement is the performance of a prohibited act with respect to a patented invention without permission from the patent holder. An employer may protect ownership rights to proprietary products and trade practices developed as part of their normal business practice. Employees setting up their own business or medical practice, however, typically have the right to pursue clients and customers, unless expressly prohibited under terms of a non-compete agreement, confidentiality agreement or non-solicitation agreement. In the event there is no non-compete agreement in place, the use of trade secrets to alter or employ a copyrighted or trademarked product or service may constitute infringement of intellectual property laws.
